The Violence Against Women Act (VAWA)The Violence Against Women Act was enacted by Congress in 2006 to protect victims of domestic violence, dating violence and stalking. A Housing Authority cannot discriminate against or refuse to admit, or evict a person who is eligible to use its programs solely because of that person's status as a victim of domestic violence, dating violence or stalking. Definitions of Domestic Violence, Dating Violence and Stalking. A Housing Authority may require proof that someone is a victim of domestic violence, dating violence or stalking. Certification forms are available. A statement from an attorney or medical personnel who have provided treatment may be used as evidence that someone is a victim. This statement must indicate that the professional who provided the service believes that their client is a victim of domestic violence, dating violence or stalking. A police report or court record or order of protection may also serve as documentation. The Housing Authority must give persons who claim victim status under the VAWA 14 business days to provide such proof. A Housing Authority must keep this information confidential unless it has a legitimate legal or business need to do otherwise. The Housing Authority may bifurcate the lease and evict the perpetrator. Someone cannot be evicted or denied admission solely on the bases of status as a victim unless the Housing Authority has reason to believe other tenants or staff members would be in danger if that person was allowed participate in its programs. Remaining household members must abide by the rules of the program and the provisions of the lease. Protection under the VAWA does not prevent a tenant's eviction due to other violations that are not related to the tenants status as a victim of domestic violence, dating violence or stalking.
